TERMS AND CONDITIONS

These Terms and Conditions ("Terms") govern your use of Nifty Pilates services, including memberships, class packages, private sessions, workshops, events, our website, and any related services provided by Nifty Pilates ("Nifty Pilates", "we", "our", or "us").
By purchasing a membership, booking a class, creating an account, accessing our website, or participating in our services, you agree to be bound by these Terms and Conditions.
1. Memberships and Class Purchases
1.1 Eligibility
Participants must be at least 16 years of age to attend classes unless otherwise approved by Nifty Pilates.
By purchasing a membership or class package, you confirm that you meet the eligibility requirements and are legally capable of entering into this agreement.
1.2 Membership Types
Nifty Pilates may offer various memberships, class packages, private sessions, workshops, promotions, and special events. Details, pricing, and benefits are available through our website and booking platform.
1.3 Account Responsibility
Clients are responsible for maintaining accurate account information, including contact information, emergency contacts, and payment details.
2. Payments
2.1 Payment Methods
Payments may be made using approved payment methods available through our website or booking platform.
2.2 Recurring Memberships
Membership fees are automatically charged according to the selected billing cycle. It is the client's responsibility to maintain valid payment information on file.
Failure to process payment may result in suspension of booking privileges or termination of membership.
2.3 Pricing
All prices are listed in Canadian dollars and are subject to applicable taxes.
Nifty Pilates reserves the right to modify pricing, memberships, packages, services, or promotions at any time. Existing recurring memberships will receive reasonable notice of any pricing changes.
3. Bookings, Waitlists, and Attendance
3.1 Class Reservations
All classes, private sessions, and appointments are subject to availability and may be booked through approved booking platforms.
3.2 Waitlists
If a class is full, clients may join the waitlist.
By joining a waitlist, clients acknowledge that they may be automatically added to a class when a spot becomes available. Once added, the reservation is subject to the standard cancellation policy.
Clients are responsible for monitoring their booking status and waitlist notifications.
3.3 Late Arrival
For the safety and experience of all participants, studio doors may be locked shortly after class begins.
Late arrivals may not be permitted to join class and may forfeit the class credit associated with the reservation.
4. Cancellations, No-Shows, and Refunds
4.1 Class Cancellations
Classes cancelled less than 8 hours before the scheduled start time are considered late cancellations and may result in the loss of a class credit, applicable fee, or other account penalty.
4.2 No-Shows
Failure to attend a booked class without cancelling is considered a no-show and will result in the loss of a class credit or additional fee.
4.3 Membership Cancellations
Recurring memberships may be cancelled in accordance with the membership terms in effect at the time of purchase.
Cancellation requests must be submitted in writing prior to the next billing cycle.
4.4 Refund Policy
Memberships, class packages, workshops, events, retail purchases, and promotional offers are generally non-refundable and non-transferable.
Exceptions may be granted at the sole discretion of Nifty Pilates.
5. Membership Holds and Extensions
Membership holds, account freezes, and credit extensions may be granted for injury, illness, pregnancy, travel, or other circumstances at the discretion of Nifty Pilates.
Requests should be submitted in writing and may require supporting documentation.
6. Health and Safety
Participation in Pilates and fitness activities involves inherent risks.
Clients are responsible for informing Nifty Pilates of any injury, medical condition, pregnancy, physical limitation, or other circumstance that may affect participation.
Clients agree to follow instructor directions and use equipment responsibly.
7. Studio Conduct
Clients are expected to conduct themselves respectfully toward instructors, staff, and fellow participants.
Nifty Pilates reserves the right to refuse service, suspend accounts, remove participants from classes, or terminate memberships without refund where behaviour is unsafe, disruptive, abusive, threatening, discriminatory, or otherwise inconsistent with maintaining a positive studio environment.
8. Schedule and Service Changes
Nifty Pilates reserves the right to:
• Modify class schedules
• Substitute instructors
• Change class formats
• Adjust operating hours
• Cancel classes or events
• Modify memberships and services
Reasonable efforts will be made to notify clients of significant changes.
9. Photography and Marketing
Photographs and videos may occasionally be taken within the studio for marketing, educational, or promotional purposes.
Clients who do not wish to appear in photographs or videos may notify Nifty Pilates in writing.
10. Personal Property
Clients are responsible for their personal belongings.
Nifty Pilates is not responsible for lost, stolen, or damaged personal property brought onto studio premises.
11. Intellectual Property
All website content, logos, branding, graphics, photos, videos, training materials, class content, and other intellectual property associated with Nifty Pilates remain the exclusive property of Nifty Pilates.
12. Website Use
Users agree not to misuse the website, interfere with website functionality, attempt unauthorized access to systems, or engage in unlawful activities through the website.
13. Disclaimer of Liability
Participation in fitness classes, private sessions, workshops, and related activities carries inherent risks.
To the fullest extent permitted by law, Nifty Pilates shall not be liable for any injury, illness, loss, damage, expense, or claim arising from participation in our services, use of our facilities, or use of our website.
14. Force Majeure
Nifty Pilates shall not be liable for any delay, interruption, cancellation, or inability to provide services due to circumstances beyond our reasonable control.
15. Privacy
Personal information collected by Nifty Pilates is governed by our Privacy Policy, which forms part of these Terms and Conditions.
16. Changes to These Terms
Nifty Pilates reserves the right to update or modify these Terms and Conditions at any time.
17. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of British Columbia and Canada.
