Acknowledgment and Assumption of Risk

I, the undersigned, acknowledge that I have voluntarily chosen to participate in Pilates classes and/or use the facilities and equipment provided by Nifty Pilates. I understand that Pilates and other exercise programs involve physical activity, including but not limited to, muscle strength, flexibility, cardiovascular conditioning, and other fitness activities.

I acknowledge that participation in Pilates involves inherent risks, including but not limited to, the risk of injury, death, or other physical or mental harm. I voluntarily assume all risks associated with my participation in Pilates classes and use of the facilities and equipment.

Medical Disclosure

I represent that I am in good health and have no medical condition or impairment that would prevent my safe participation in Pilates classes. I have disclosed any relevant medical conditions or concerns to Nifty Pilates. I understand that it is my responsibility to consult with a physician before starting any new exercise program, including Pilates.

Release of Liability

In consideration of my participation in Pilates classes and use of the facilities and equipment, I hereby release, waive, discharge, and hold harmless Nifty Pilates, its owners, instructors, employees, agents, and representatives (collectively, the "Released Parties") from any and all claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that I may sustain as a result of my participation in Pilates classes or use of the facilities and equipment, whether caused by the negligence of the Released Parties or otherwise.

Indemnification

I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost, including attorneys' fees, that they may incur due to my participation in Pilates classes or use of the facilities and equipment, whether caused by the negligence of the Released Parties or otherwise.

Photography and Media Release

I consent to the use of my image, photograph, or likeness in any promotional or advertising materials produced by or for Nifty Pilates. I understand that my image may be used in various media, including print, digital, and social media platforms, and I waive any right to royalties or other compensation arising from such use.

Governing Law

This waiver and release shall be governed by and construed in accordance with the laws of the Province of British Columbia.

Acknowledgment of Understanding

I have read this waiver and release, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue the Released Parties. I acknowledge that I am signing this waiver and release freely and voluntarily and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
